The reason I am able to offer this service is because my consulting approach includes continued monitoring of my client’s business and thus offering the fiduciary element is a very simple, inexpensive, value added service that is just another way to fulfill the “total picture” objective.
This particular service is a very important factor when dealing with financing and especially if you have had some renegotiating of debt performed. Many times the bank or creditor will insist on you hiring a competent consultant to perform in a fiduciary capacity as part of their conditions for financing or accepting a re-negotiated settlement. A reputable consultant can, and will, use his working relationship with his clients to help them secure better opportunities with vendors, banks, and other creditors. This capacity allows me to be able to re-negotiate many secured debts such as equipment leases, working lines of credit, and even emergency cash advances to deal with unexpected temporary financial problems such as major machinery repairs, growth inventory advances, receivable advances and so forth.
Essentially, although I work for the client, I would have an obligation to the creditor to report continued progress and forecast the likelihood of dramatic changes in the cash flow of the business. This objective is easily accomplished under my normal consulting program and adds only minor fees to the agreement. Depending upon the creditors requirements.
Fiduciary relationships bridging clients and creditors provides much the same benefit as using a recognized outside accounting firm for your books and taxes. Since they have a reputation to uphold, are a non-vested, independent third party what they report is taken very seriously as an indication of the true position of the client’s company.
